REPRESENTATIONS

I represent that I am the legal owner of the animal (the “Pet”) that I will be bringing into The Dog House (the “Premises”) or that I have the consent of the legal owner for my temporary custody of the Pet, and I assume all risks, dangers and responsibility for injuries to the Pet. I understand and agree that I am solely responsible for any harm to the Pet while the Pet is at the Premises, including, without limitation, scratches, punctures, torn ligaments, and other injuries.

I understand and agree that neither The Dog House, LLC nor any of its employees, staff or volunteers, will be liable for any illness, injury, death, and/or escape of the Pet, and I hereby release all of them of any liability of any kind whatsoever arising from or as a result of the Pet’s presence at the Premises.

I represent and agree that the Pet is healthy, has current vaccinations, is spayed/neutered, does not have any condition that could potentially jeopardize the health of other dogs or people, and has not had any potentially communicable condition within the last 30 days.

Proximity to live animals carries with it inherent risks that include but are not limited to physical injuries and transmission of certain infectious diseases. These risks cannot be eliminated regardless of the care taken to avoid injuries. Knowing these risk, I choose to enter the Premises. In consideration for being allowed to patronize the Premises, I agree that:

WAIVER

I, for myself, my heirs, personal representatives and assigns, agents, employees and affiliates, do hereby release, waive, discharge, and covenant not to sue The Dog House, LLC, its affiliates, direct or indirect, members, managers, employees, and agents from all liabilities, claims, actions, damages, costs or expenses arising from the presence of myself or the Pet in the Premises and/or any harm or damage to me or the Pet caused by any other animal on the Premises or by any other patron in any manner connected to said patron’s pet.

ASSUMPTION OF RISK

I hereby assume all risks and accept sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability or expense, of any kind, that I and/or the Pet may experience or incur in connection with our presence in the Premises.

INDEMNIFICATION AND HOLD HARMLESS

I agree to indemnify (cover any costs) and hold harmless (agree not to sue) The Dog House, LLC, its affiliates, direct or indirect, members, managers, employees, and agents from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of the presence of myself or the Pet in the Premises, whether brought by me or other third parties.

ACKNOWLEDGMENT OF UNDERSTANDING

I have read this Waiver of Liability, Assumption of Risk and Indemnity Agreement, fully understand its terms, and understand that I am giving up my right to sue. I acknowledge that I am signing this agreement freely and voluntarily and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
